Cindy’s Swim School Shop Terms & Conditions of Sale
This agreement applies as between you, the User of this Website and Cindy’s Swim School LLP, the owner(s) of this Website. As we can accept your order and make a legally enforceable agreement without further reference to you, you must read these Terms and Conditions to make sure that they contain all that you want and nothing that you are not happy with.
1. Application
1.1 These Terms and Conditions will apply to the purchase of Goods by you (the Customer or you). We are Cindy’s Swim School LLP whose trading name is Cindy’s Swim School, a limited liability partnership registered in England and Wales under number OC424849, whose registered office is at Albany House, Claremont Lane, Esher, Surrey, KT10 9FQ; (the Supplier or us or we).
1.2 These are the terms on which we sell all physical goods available at or through our Website to you, hereafter Goods. By ordering any Goods, you agree to be bound by these Terms and Conditions. Before placing an order on the Website, you will be asked to agree to these Terms and Conditions by clicking on the button marked ‘I Accept’. If you do not click on the button, you will not be able to complete your Order. You can only purchase Goods from the Website if you are eligible to enter into a contract and are at least 18 years old.
2. Placing an Order
2.1 When placing an order online you will receive an order confirmation email from us which will contain the details of your order. Please check these and if you see any errors please contact swimshop@cindyswimschool.co.uk with the order details. We may not be able to edit an order if it has been processed and dispatched, and you should then follow the Returns procedure as set out in Paragraph 5.
2.2 We may refuse to accept an order;
(a) where goods are not available;
(b) where we cannot obtain authorisation for your payment;
(c) if there has been a pricing or product description error;
(d) if the order delivery is to an overseas address (we only accept orders from the United Kingdom of Great Britain and Northern Island); or
(e) if you choose “Customer Collection at Pool” as your shipping option, but you are not a current customer of weekly swimming lessons at Cindy’s Swim School.
3. Products and Pricing
3.1 Whilst every effort has been made to ensure that all graphical representations and descriptions of goods available from Cindy’s Swim School correspond to the actual goods, we are not responsible for any variations from these descriptions. This does not exclude our liability for mistakes due to negligence on our part and refers only to variations of the correct goods, not different goods altogether.
3.3 Cindy’s Swim School does not represent or warrant that such goods will be available. Stock indications provided on our website are not a guarantee of stock availability.
3.4 All prices include VAT (where applicable) at the current rates. We reserve the right to express the price exclusive of VAT, but we shall show VAT separately and include it in the total price.
4. Delivery
4.1 All shipping costs will be priced on the website according to the item being purchased. When purchasing multiple items the delivery will be combined and priced accordingly.
4.2 Customer Collection at Pool: This is only available to current customers of Cindy’s Swim School weekly swimming lessons. Parcels will be available to collect only after a customer email has been sent to you to confirm the parcel will be ready to pick up at your next lesson. During school holidays no parcels will be delivered to the pools.
4.3 Royal Mail 1st Class delivery: This is not a guaranteed next day service with parcels usually arriving between 1-3 working days. Please note an item is not classed as lost until 10 working days after posting. Items can only be re-sent or refunded after this date.
5. Returns
Cindy’s Swim School aims to always provide high quality goods that are fault free and undamaged. On occasion however, goods may need to be returned. Returns and refunds are governed by these Terms and Conditions.
5.1 If you receive goods which do not match those that you ordered, unless accompanied by an explanatory note detailing the changes, stating reasons for the changes and setting out your options, you should contact us within 7 days to arrange collection and return. You will be given the option to have the goods replaced with those ordered (if available) or to be refunded through the payment method used by you when purchasing the goods. Refunds and replacements will be issued upon our receipt of the returned goods in their original and undamaged packaging, with tags intact.
5.2 If any goods you have purchased have faults when they are delivered to you, you should contact us within 7 days to arrange collection and return. Goods must be returned in their original condition with all packaging and documentation. Upon receipt of the returned goods, you will be given the option to have the goods replaced with those ordered (if available) or to be refunded through the payment method used by you when purchasing the goods.
5.3 You have a statutory right to a “cooling off” period. This period begins once your order is complete and ends 7 working days after the goods have been delivered. If you change your mind about the goods within this period, please return them to Cindy’s Swim School within 7 working days of receipt. You are responsible for paying shipment costs if goods are returned for this reason.
5.4 If you require an alternative size or color for your product, please re-order via our website. We will be more than happy to offer a refund for any unworn items returned to us in their original and undamaged packaging, with tags intact. You are responsible for paying shipment costs if goods are returned for this reason.
5.5 If you wish to return Goods to Cindy’s Swim School, please contact us at swimshop@cindysswimschool.co.uk to request a Returns Slip, which you should complete with all details so that we are able to identify your return and process your request as soon as possible. Please return any items in compliance with these Terms and Conditions to the address stated on the returns slip, within 30 days of receipt.
5.6 Please note that we will ONLY be able to offer a refund if these conditions are met and failure to comply will result in a delayed or unfulfilled refund. The costs of returning any goods are the responsibility of the sender unless the order was incorrectly fulfilled or the goods were faulty, in which case you must provide proof of shipping costs for the return so that we can reimburse you.
5.7 Upon receipt of the goods, and in compliance with these Terms and Conditions, we will give you a full refund of the amount paid.
These conditions do not affect your statutory rights if the goods are damaged or faulty in any way.
